3/4 VOTE RESOLUTION - BYLAW AMENDMENT (PETS)

BE IT RESOLVED as a 3/4 Vote Resolution of the Owners, Strata Plan VR 732, Spuraway Gardens (the "Strata Corporation"), that the Bylaws of their Strata Corporation be amended as follows, such amendment to be effective upon the filing of an Amendment to the Bylaws in prescribed form at the Land Titles Office:

Bylaw 38 currently reads as:

No person shall bring a pet onto any part of the common property or a strata lot.

To now read as follows:

38 (a) Strata Lot residents shall be entitled to keep only one (1) indoor cat in a Strata Lot, Strata lot residents may be entitled to keep up to two (2) small caged animals, Strata Lot residents may be entitled to keep a reasonable amount of aquarium fish, and/or a reasonable amount of aquarium animals.

(b) . The owner, tenant, or occupant will maintain a regular flea control and vaccination program appropriate to the type of pet. Should flea infestation from these pet(s) occur on the residential property, the Strata Council may require all owners who use the space to have the carpets shampooed and de-fleaed. Failure by the owners to act promptly on the Strata Council’s request will be in breach of the Schedule of Standard Bylaws Use of property 3(2).

(c) The owner must act in accordance with the Schedule of Standard Bylaws Use of property 3(1)(b). If the owner, tenant, or occupant’s pet(s) are disturbing the quiet enjoyment of others, the owner, tenant, or occupant will remediate the problem,

(d) The pet(s) must not be left in the unit if the owner, tenant, or occupant will be absent from the unit for an extended period of time. If the pet(s) are left in the care of an alternate caregiver in the unit, the name and telephone number for the caregiver must be provided to the Strata Council.

(e) Prohibited or restricted exotic animals, as defined by the B.C. Wildlife Act Controlled Alien Species Regulation, are not permitted as pets.
