საქართველოს პრეზიდენტს
ბატონ მიხეილ სააკაშვილს
ბატონო პრეზიდენტო,
შეზღუდული შესაძლებლობის მქონე პირთა უფლებების დაცვის მდგომარეობა, ცალკეული მცდელობების მიუხედავად, ჯერ კიდევ სერიოზულ გამოწვევად რჩება ქვეყანაში. შეზღუდული შესაძლებლობის მქონე პირები პრობლემებს აწყდებიან სოციალური ფუნქციონირების ყველა სფეროში, იქნება ეს პირადი გადაადგილება, განათლება, სოციალური მომსახურება, რეზიდენტული დაწესებულებები თუ სხვ. ამას ადასტურებს როგორც საქართველოს სახალხო დამცველის ანგარიშები, ისე გაეროს უნივერსალური პერიოდული გადახედვის მექანიზმის შესაბამისად, საქართველოს სამოქალაქო საზოგადოების მიერ მომზადებული ანგარიში.
ამ მდგომარეობის გასაუბჯობესებლად უდავოდ წინგადადგმული ნაბიჯი იყო 2009 წლის 10 ივლისს გაერთიანებული ერების ორგანიზაციაში საქართველოს ელჩის მიერ გაეროს შეზღუდული შესაძლებლობის მქონე პირთა უფლებების შესახებ კონვენციის ხელმოწერა. ამ ფაქტმა გააჩინა მოლოდინი, რომ საქართველო შესაბამისი შიდა პროცედურების გავლის შემდეგ მოახდენდა კონვენციის რატიფიცირებას და საერთაშორისო სტანდარტების შესაბამისად, გადადგამდა ნაბიჯებს შეზღუდული შესაძლებლებლობის მქონე პირთა მდგომარეობის გაუმჯობესების მიზნით. თუმცა, ამ დრომდე, ჩვენთვის გაუგებარი მიზეზების გამო, აღნიშნული არ განხორციელებულა.როგორც მოგეხსენებათ, საქართველოს კანონმდებლობის შესაბამისად, საერთაშორისო ხელშეკრულებას სარატიფიკაციოდ საქართველოს პარლამენტს წარუდგენს მხოლოდ საქართველოს პრეზიდენტი.
აღნიშნულიდან გამომდინარე, მოგმართავთ, გამოიყენოთ თქვენი კონსტიტუციით მინიჭებული უფლებამოსილება და საქართველოს პარლამენტს, უახლოეს მომავალში, მიმართოთ კონვენციის რატიფიცირების მოთხოვნით.
