If as stated the dog was on the owners property and the complainant came onto that property at night and was subsequently bitten. It is the complainants fault. The complainant should be charged with wilful trespass, at the very least and the council should return the animal to his rightful owner, with a written apology AND any compensation that could be reasonably expected.
